Diário Oficial entrevista Vereador Jair da Mendes Gomes
Segundo o ranking de auxílios-doença concedidos pelo INSS, a dor nas costas (dorsalgia) é a doença que mais afasta trabalhadores por mais de 15 dias no Brasil. Em 2016, mais de 116 mil pessoas tiveram de se ausentar do emprego em razão dessa enfermidade. Por ano, o governo gasta cerca de R$ 30 bi com esses auxílios, e parte dos afastamentos é devido ao excesso de peso carregado pelos trabalhadores da construção civil. Para proteger a saúde dos operários cariocas, o vereador Jair da Mendes Gomes (PMN) propôs o Projeto de Lei 110/2017, que limita o saco de cimento comercializado na cidade a 25 Kg. A equipe da ASCOM conversou com o parlamentar, que explica detalhes do projeto.
ASCOM: Por que limitar a venda de sacos de cimento no município a 25 quilos?
Jair da Mendes Gomes: O Instituto Internacional de Saúde no Trabalho determina que o limite de peso que uma pessoa pode carregar, sem afetar a sua saúde, é de 23 kg. Os EUA e a União Europeia já trabalham com esse limite de peso para sacos de cimento comercializados em seus territórios. Agora veja só: no Brasil, o limite de peso que um trabalhador pode carregar previsto pela CLT é de 60 kg. É uma completa distorção sobre a capacidade humana de levantar peso sem prejudicar a saúde. Isso precisa ser revisto. O prefeito Marcelo Crivella possui um Projeto de Lei tramitando no Senado Federal propondo a mudança desse limite para 30 kg. Essa medida para a realidade brasileira já seria um grande avanço. Mas o que estou propondo é um corte na raiz do problema, que afeta milhares de trabalhadores da construção civil.
ASCOM: Caso aprovada a Lei, o Sr. tem alguma estimativa do custo que as empresas terão para se adequarem à nova legislação, uma vez que a alteração do peso do saco implicaria a necessidade de mudanças na linha de produção?
Jair da Mendes Gomes: Obviamente que haverá um custo, mas sem grandes impactos para o setor. Hoje em dia, as empresas já produzem e comercializam em larga escala pacotes de 25 kg. É uma prática corrente no mercado.
ASCOM: Como tem sido a reação do setor produtivo? Eles estão dispostos a adotarem a medida ou mesmo discuti-la para aprimorá-la?
Jair da Mendes Gomes: Com o tempo eles entenderão que o projeto trará benefícios a todos, inclusive a ela própria, pois promove mais saúde para os trabalhadores, economia para os cofres públicos – que terá redução de gasto com pedidos de auxílio-doença – e a diminuição do risco de afastamentos do trabalho por motivos de doença. Além disso, o tema não é novo. No Brasil inteiro existem proposições neste sentido, inclusive no Congresso Nacional, mas que estão paradas. Eu confio que aqui no Rio a proposta vai andar. O Rio sempre foi vanguarda da política nacional e sempre pautou as ações mais importantes para o resto do país. Tenho plena convicção que meus pares vão compreender a importância do tema e aprová-lo para proteger a saúde da população carioca.
ASCOM: Uma vez aprovada a Lei, teria algum tipo de fiscalização prevista para evitar o abuso de peso?
Jair da Mendes Gomes: Um ajudante de pedreiro hoje não pode se negar a carregar um saco de cimento de 50 kg na cabeça porque há um absurdo jurídico que permite que ele carregue até 60 kg. Quando a lei estiver em vigor, esse operário vai poder se negar a cumprir uma prática ilegal. A regulamentação do projeto caberá à prefeitura do Rio, inclusive indicando quem serão os fiscais responsáveis. Acredito que a sociedade e os Poderes vão fazer valer a lei, e a Comissão de Abastecimento, Indústria, Comércio e Agricultura da Câmara Municipal estará debruçada nesta questão, cobrando e fiscalizando os empresários que agirem ilegalmente.
ASCOM: O Município tem competência para legislar sobre segurança e medicina do trabalho, ou mesmo sobre o transporte manual de cargas, uma vez que na CLT há previsão expressa da quantidade limite a ser transportada pelo trabalhador?
Jair da Mendes Gomes: A CLT diz que o limite de peso que um trabalhador pode carregar é de até 60 Kg. Minha proposta não altera a CLT e nem versa sobre segurança do trabalho e transporte de cargas. Ela simplesmente limita a venda de sacos de cimento a 25 Kg, o que trará benefícios para todos sem interferir na legislação federal.
DCM: Seu Projeto de Lei prevê sanção para a comercialização do saco de cimento acima do peso estipulado e prazo de transição para adequação das indústrias do setor?
Vereador Jair da Mendes Gomes: O projeto prevê prazo de 90 dias para que o setor se adapte à medida e que a regulamentação da nova lei ficará a cargo da prefeitura.
